Report: Impact of India's Personal Data Protection Bill, 2019, on the Healthcare Sector

This report summarises the concerns that were raised during our virtual discussion on the impact of the PDP Bill, 2019, on the healthcare sector held on June 19, 2020. The discussion saw participation from multiple stakeholders including doctors, healthcare professionals, lawyers and policy professionals.

The need to define health data, health services and medical/health emergencies emerged as a key theme. Panelists also highlighted that the Bill does not take into account differing abilities of healthcare providers to comply with the Bill, thereby creating a need for a graded approach. The panelists concurred that consent, in the case of processing health data, lacks exploration in the Bill, and a healthcare specific privacy legislation is required.
